Under the GDPR you are, in principle, entitled to the following rights:

If you are of the opinion that the processing of your data violates data protection law, you can lodge a complaint with a supervisory authority. As the controller does not maintain an establishment in the EU, there is no lead authority (no one-stop-shop); you can contact the data protection supervisory authority of your habitual residence, your place of work or the place of the alleged infringement. In Austria this is the Austrian Data Protection Authority (Österreichische Datenschutzbehörde) (Barichgasse 40-42, 1030 Vienna, dsb@dsb.gv.at, www.dsb.gv.at); in Germany this is the respective competent state data protection authority or the Federal Commissioner for Data Protection and Freedom of Information (BfDI).
3. Hosting
This website is hosted by an external service provider (processor):

On our behalf, Hostinger processes in particular access data, contact requests and other data generated via a website. The data processing is carried out on the basis of our legitimate interest in a secure and efficient provision of our online offering (Art. 6(1)(f) GDPR). A data processing agreement (DPA) pursuant to Art. 28 GDPR has been concluded with the provider.
4. Server Log Files
When our website is accessed, the hosting provider automatically collects information and stores it in so-called server log files, which your browser transmits automatically. These are in particular:
- IP address of the accessing device
- Date and time of access
- Name and URL of the retrieved file
- Website from which the access is made (referrer URL)
- Browser used and, where applicable, the operating system
The processing is carried out on the basis of our legitimate interest (Art. 6(1)(f) GDPR) in the technically error-free presentation and the security of our website. This data is not merged with other data sources.
5. Contacting Us (Contact Form and Email)
If you contact us via the contact form or by email, your details (e.g. name, company, email address, telephone number and your message) are stored by us for the purpose of processing the enquiry and in case of follow-up questions.
The legal basis is Art. 6(1)(b) GDPR (initiation or performance of a contract) as well as our legitimate interest in answering enquiries (Art. 6(1)(f) GDPR). The data is deleted as soon as it is no longer required to achieve the purpose and no statutory retention obligations stand in the way.
6. Appointment Booking via Calendly
For the booking of appointments (e.g. AI potential analysis) we use the service Calendly of Calendly LLC, 271 17th St NW, Atlanta, GA 30363, USA.
When you book an appointment, the data you enter (e.g. name, email address, requested appointment and, where applicable, further details) is processed by Calendly. The legal basis is Art. 6(1)(b) GDPR (initiation of a contract) or your consent (Art. 6(1)(a) GDPR).

7. Google reCAPTCHA
To protect our contact form against automated entries (spam), we use Google reCAPTCHA of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.
reCAPTCHA analyses the behaviour of website visitors on the basis of various characteristics (including IP address, time spent, mouse movements). The legal basis is our legitimate interest in defending against abuse and spam (Art. 6(1)(f) GDPR). In this context, data may be transferred to Google (including to the USA); the transfer is based on the EU standard contractual clauses (Art. 46 GDPR). 8. Automatic Language Detection (Geolocation)
So that the website is automatically displayed to you in the appropriate language (German or English), we determine the approximate country of origin from your IP address on your first visit. For this purpose, your IP address is transmitted to the service ipapi.co (Kandi Software, USA), which returns only the corresponding country code.
No further evaluation and no profiling take place. The result (selected language) is stored for 180 days in a technically necessary cookie (automiq_lang) so that the query is made only once; you can change the language yourself at any time via the language switcher. The legal basis is our legitimate interest in a user-friendly, language-appropriate presentation of our online offering (Art. 6(1)(f) GDPR). 9. Fonts
This website embeds all fonts used locally (self-hosted) from our own server. No connection to Google servers or other third parties is established; in particular, your IP address is not transmitted to third parties for the purpose of providing fonts.
10. Cookies
Our website uses exclusively technically necessary cookies that are required for the operation of the website. This includes in particular the cookie automiq_lang for storing your language selection. In addition, Google reCAPTCHA (see point 7) may set cookies that serve to defend against spam. The legal basis is our legitimate interest (Art. 6(1)(f) GDPR) or the applicable national provisions implementing the ePrivacy Directive.
We do not use any analytics or marketing cookies and no user-related tracking. Most browsers also allow you to restrict or prevent the storage of cookies; this may limit the functionality of the website.
11. Recipients and Third-Country Transfers
Your data is transferred to third parties only insofar as this is necessary for the performance of the contract, you have consented or there is a legal obligation. With some of the services mentioned above (in particular Google reCAPTCHA, Calendly and ipapi.co), data is transferred to the USA.
In addition, the controller (AUTOMIQ LLC) is established in the USA. Within the scope of administration, communication and the handling of enquiries, personal data may therefore be processed in the USA. The transfer to the USA is based on appropriate safeguards, in particular the EU standard contractual clauses pursuant to Art. 46 GDPR. In the USA there may be no level of data protection comparable with the EU; in particular, US authorities may access personal data under certain conditions.
12. Storage Period
We store personal data only for as long as is necessary for the respective purposes or as required by statutory retention obligations (e.g. commercial and tax law periods). After that, the data is deleted.
13. Data Security
We take appropriate technical and organisational security measures to protect your data against manipulation, loss, destruction and access by unauthorised persons. The transmission is encrypted via the TLS/SSL protocol.
14. Changes to this Privacy Policy
We reserve the right to adapt this privacy policy so that it always complies with current legal requirements or in order to implement changes to our services. The respective current version applies to your renewed visit.
